General Terms and Conditions of Sale

Preamble: Status and Collaboration with Nomadays

For your legal and financial peace of mind, VOYAGE SERIPHEAP has joined the local agency collective Nomadays, its partner in France.

Nomadays is a licensed tour operator in France, enabling you to benefit from all the guarantees, insurance, and protections under French law before, during, and after your stay.

This partnership has been established to ensure two things: first, that VOYAGE SERIPHEAP can organize your trip independently and freely, without intermediaries, and second, to provide the payment security and contractual protections guaranteed by any tourism company regulated by French law.

For this reason, the quote is issued by VOYAGE SERIPHEAP, as well as the travel documents you will receive. However, the invoice, registration form, and online payment are processed under the name of Nomadays, which then transfers the amounts due to VOYAGE SERIPHEAP.

Special Conditions of Sale

These special conditions of sale govern the relationship between VOYAGE SERIPHEAP, a Cambodian company registered under numbers MOC-87618889 (Ministry number) and 00027985 (registration number), represented by Mr. Cyrille TOP, with its headquarters located in Phnom Penh, BKK1 District, #52 E1 Street 282 (hereinafter referred to as "Seripheap"), phone number: 016 47 47 42, email: [email protected] (hereinafter referred to as the "Local Agency"), and the Client (hereinafter referred to as the "Client").

The Client acknowledges having read these special conditions of sale and the description of the chosen trip. Any booking of a stay implies the full acceptance of these special conditions of sale.

I. Quotes and Reservations

I.1. Quotes and Types of Stays

The stays organized by the Local Agency are divided into two main categories:

  • Group trips with fixed dates
  • Private trips (tailor-made or according to pre-established programs)

All of these products are referred to as "stays" in these special conditions of sale.

Prices are calculated based on the specificities of each stay, including activities and services included. Prices listed on the Local Agency's website are indicative and may be subject to change.

The final price is specified in the quote provided by the Local Agency. The quote may include an expiration date, after which the quoted price is no longer guaranteed.

If the validity period of the quote expires, the Local Agency may issue a new quote upon the Client's request.

I.2. Group stays with fixed dates

The Local Agency forms groups as reservations are received.

Groups consist of a minimum of three participants and a maximum of ten participants.

This maximum cannot be exceeded unless all registered participants agree.

However, the maximum number may be increased to eleven if the last reservation, made when there are already nine participants, is for two people traveling together, and this is done without consulting other participants.

Departures are guaranteed with at least three participants.

If there are only two participants, the Local Agency agrees to proceed with the departure, provided the participants pay a supplement, the amount of which varies based on the tour and is indicated on the website, on the page for each trip.

If the two participants refuse this offer, the Local Agency will propose an alternative trip from its own selection with similar dates. If necessary, the two participants may be referred to another travel agency.

If the participants reject all proposals, the Local Agency commits to refunding the deposit in full within 15 days after their refund request.

Prices for these types of stays are listed on the Local Agency's website on the relevant trip page.

I.3. Private stays

Clients who wish to travel exclusively with their friends or family, without other travelers, may privatize a trip. Departure and return dates are freely chosen, and the price depends on the number of participants. Various prices are listed on the Local Agency's website on the relevant trip page.

The private trip is flexible; services can be added or removed, and the itinerary can be modified. The price may then be adjusted based on the changes made. In this case, the Local Agency will send a personalized quote to the client.

The Local Agency agrees not to add any additional participants to a private group trip, unless the group expressly requests it.

In the event of cancellation by one or more members of the exclusive group, refer to section 4.2.

I.4. Description of itineraries and services

The photos on the Local Agency's website are for illustrative purposes only, intended to show the landscapes the Client is likely to encounter during their trip. They do not constitute any contractual commitment from the Local Agency.

Travel times are purely indicative and do not constitute contractual commitments.

Some trips may include encounters with local people or even homestay accommodations. The Local Agency will make every effort to ensure that these encounters happen in the best possible conditions, especially if the tour is guided, by working with guides who have good interpersonal skills and can facilitate interactions between locals and clients. However, the Local Agency cannot guarantee the quality of every encounter from one family to another or from one day to the next.

Additionally, it should be noted that homestay services differ from those of a hotel. A family may have constraints (work, illness, etc.) that temporarily prevent them from hosting clients under optimal conditions.

I.5. Reservation process

Any request for registration must be made by email to the Local Agency or directly online via the Client Area accessible on the Local Agency's website or through our collective platform at www.nomadays.fr.

To log in to the Client Area, simply enter the username and password created during the first login.

The registration is considered final once the online reservation form is completed, and upon receipt of the deposit and/or balance, depending on the registration date. Depending on the services selected and the country's regulations, the Local Agency may request a photocopy of the passport. If the photocopy of the passport is not sent within the indicated timeframe, the Local Agency cannot guarantee the proper execution of the reserved services.

Once the payment is made, a confirmation email is sent to the Client, which includes the payment confirmation and a downloadable electronic invoice.

An acknowledgment of receipt is also sent to the Client electronically. In the event the Client does not receive the acknowledgment, the reservation will still be considered final as soon as it is received by the Local Agency.

II. Payment Terms

II.1. Payment Schedule

Registration more than 30 days before the departure date
The client must pay a deposit of 30% of the total cost of the services reserved. If an internal flight or other transport ticket is booked, the Local Agency may also require full payment for this transport to confirm the reservation. The balance of the trip must be paid no later than 30 days before the start date of the trip.

Registration less than 30 days before the departure date
The client must pay the entire amount of the trip in one single payment.

In case of non-payment within the specified deadlines, the Local Agency reserves the right to cancel the services and apply the fees outlined in section 4.2 below.

As part of the trip, the Client has the option to purchase insurance services. The premium for this insurance is due at the time of registration.

II.2. Payment methods

Payments can be made by:

  • Credit card online, through the payment links available on the electronic invoice
  • Bank transfer to the Nomadays company account

The electronic invoice is updated with each payment received and can be accessed at any time from the Client Area. It is also downloadable and printable.

III. Preliminary recommendations for the trip

III.1. Administrative and health formalities

Before embarking on the trip, the Client is advised to ensure that they are in compliance with all administrative requirements regarding police, customs, and health regulations (valid passport, required visa, exit authorizations for minors, vaccination certificate, recommended vaccines). It is strongly recommended to verify all information with the relevant authorities. Neither Nomadays nor the Local Agency can be held responsible for the consequences of the Client's failure to comply with police, customs, or health regulations before or during the trip.

III.2. Safety and health risk information

The Local Agency advises consulting the country-specific information on the destination, published by the French Ministry of Foreign Affairs (MAE) on their website www.diplomatie.gouv.fr, under the “Travel Advice” section.

Please note that this information can change up until the departure date, so it is advisable to check it regularly. The Client is also encouraged to stay updated with information released by the competent authorities regarding health risks associated with the trip and to follow health recommendations and measures to combat these risks, which can be accessed on the websites www.sante.gouv.fr (French Ministry of Health) and www.who.int/fr (World Health Organization).

III.3. Physical and psychological fitness

The Client must ensure that their physical condition is suitable for the planned trip. The difficulty and comfort levels are specified on the trip description and travel documents. It is important to be in good health, and it is recommended to consult a doctor before the trip. The Local Agency cannot be held responsible for any physical inadequacy revealed during the course of the trip.

IV. Modifications and cancellations requested by the client

IV.1. Modification of travel services

Any modification of the services after signing the registration form may be considered as a cancellation by the Client, followed by a rebooking. As a result, the Local Agency reserves the right to charge the fees mentioned in section 4.2.

However, the Local Agency will do its best to minimize any modification fees.

Please note that these potential fees are not refundable under the cancellation insurance policy.

IV.2. Cancellation conditions and fees

If the Client needs to cancel the trip, they must inform the Local Agency and their insurer in writing by any means that provides acknowledgment of receipt, as soon as the reason for the cancellation occurs. The date of the written notification will be considered as the cancellation date for calculating cancellation fees. As a general rule, the insurance company will assess, based on the documents provided by the Client, the reason for the cancellation in order to decide whether to reimburse the cancellation fees.

Cancellation fee scale (total cancellation):

  • More than 45 days before the departure date: 30% of the total price (including taxes)
  • From 44 to 31 days before the departure date: 40% of the total price (including taxes)
  • From 30 to 14 days before the departure date: 50% of the total price (including taxes)
  • From 13 to 7 days before the departure date: 75% of the total price (including taxes)
  • Less than 7 days before the departure date: 100% of the total price (including taxes)

Partial cancellation fee scale (unless special cases):

If a traveler registered for a privatized trip cancels their participation, while the trip is maintained for other participants:

  • For personal services (non-shared): the above cancellation fee scale will apply to the traveler who cancels.
  • For shared services: fees equal to 100%, regardless of the cancellation date, will be charged to the participant who cancels their share of the shared services.

When several clients are registered under the same file and one of them cancels their trip, the cancellation fees are deducted from the amounts already received for that file, regardless of who made the payment.

Special cases :

  • 100% cancellation fees may apply immediately upon registration for cruises and/or certain hotels.
  • 100% cancellation fees may apply immediately upon registration for certain trip services (excursions, cooking classes, etc.). The mention “non-refundable service” will be specified on the trip quote if applicable.
  • 100% cancellation fees apply for all domestic flights.

In case of cancellation, for any reason, expenses external to the trip booked with the Local Agency and incurred by the Client, such as transportation costs to and from the departure point (plane, train, or bus tickets), visa fees, travel documents, vaccination fees, will not be eligible for any reimbursement.

The provisions of the total and partial cancellation fee scales are cumulative with the provisions under "Special Cases."

IV.3. Transfer of Contract

In the event of a transfer of the contract, the Client must inform the Local Agency no later than 7 days before the departure via email. This transfer is possible subject to the availability of air transport and the adequacy of the transferee. It may incur additional costs (especially if the flight ticket or nominative services need to be modified), which will be charged to the transferee. In any case, the transferor and the transferee are jointly responsible for paying the trip price and any additional fees.

IV.4. Modification during the trip at the client's request

Any modification to the program requested by the Client can only be implemented with the agreement of the Local Agency. Any additional costs incurred by this modification are the responsibility of the Client and must be paid on-site to the Local Agency.

IV.5. Trip interruption

Any trip interrupted by the Client (for health reasons or otherwise) does not entitle them to any reimbursement for the unused services from the Local Agency. Additional costs incurred as a result of this interruption will not be covered by the Local Agency.

V. Modifications and cancellations by the local agency

V.1. Cancellation by the local agency

Events constituting force majeure (such as wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.) may lead to the cancellation of the reserved trip. In such cases, the Local Agency and/or Nomadays will send an informational email to the Client. The Client will then have the option to either receive a refund or defer the payment to another trip of their choice. However, the Client will not be entitled to any compensation from the Local Agency or Nomadays.

V.2. Modification du voyage

Between the time of confirmation and the departure, modifications to the program (dates, times, itinerary, supervision, accommodations, etc.) may occur due to organizational difficulties or security concerns. In such cases, the Local Agency will immediately inform the Client of these modifications by email. If this modification affects a significant element, the Client will have the option to either cancel the contract or accept the proposed modification by the Local Agency.

During the trip, program modifications (dates, times, itinerary, supervision, accommodations, etc.) may also occur due to organizational difficulties or security reasons. If replacement services can be offered by the Local Agency, any additional costs will be covered by the Local Agency. If no replacement services are available, and except in the case of force majeure, the Local Agency commits to refunding the price difference between the planned services and those actually provided.

A program involving a domestic flight may be modified, even after the start of the trip, depending on the final flight schedule (delays or changes to the schedule are possible). The Local Agency cannot be held responsible for program changes due to domestic flight schedule changes or delays.

V.3. Guides' interventions

Traveling in a group inevitably involves compromises to adapt to external circumstances, the objectives of the trip, and the physical capabilities and personalities of the participants. In this context, the expedition leaders from the Local Agency and/or local guides may need to make decisions in the best interests of the group, which may not necessarily align with the expectations of certain participants. The good faith of the guides regarding such decisions will never be questioned, and the Client agrees not to hold the Local Agency responsible for any decision made by the guide in the interest of the group.

The Local Agency reserves the right to refuse or remove any person participating in the trip if their behavior or physical condition disrupts the proper functioning of the trip or is detrimental to the safety, enjoyment, or interests of the other participants. Any person asked to leave the trip for the above reasons will be responsible for the costs incurred by their departure from the excursion and their return home, and no claims or requests for compensation will be considered by the Local Agency.

V.4. Trip interruption

Any trip can be interrupted by the guide for justified reasons (security, health, etc.). In this case, unless the interruption is due to a force majeure event, the Local Agency agrees to refund the price difference between the planned services and those actually provided.

VI. Air transport

VI.1. Transport services

The Local Agency does not sell international flights. The Client is solely responsible for reaching the destination. However, it is recommended to consult the European list of banned airlines on the website ec.europa.eu/transport/air-ban/list_fr.htm before booking tickets for the trip.

The Local Agency and Nomadays have partnered with “La Bourse des Vols” to assist participants with booking international flights. The Local Agency may then advise the Client on the best flight options for their trip. The flight must be booked directly with La Bourse des Vols, and the Client will be subject to the general sales conditions of this company.

For more flexibility, it is recommended to purchase modifiable and/or refundable services and to allow sufficient transfer times between airports/stations.

In the event of force majeure, or unforeseen and insurmountable events caused by a third party or the Client, it is recommended to inform the Local Agency as soon as possible. Changes to services and the associated costs resulting from these events will remain the responsibility of the Client.

Internal flights may be included in the trip. The Local Agency will inform the Client during registration of the identity of the airline(s) providing these domestic flights. If there is any modification after registration, the Local Agency will inform the Client of any changes to the airline(s) as soon as possible.

The Local Agency commits to ensuring that all airlines used are approved by the relevant administrative authorities.

VI.2. Transport conditions

The general and specific transport conditions of airlines can be accessed via their websites. In accordance with the Warsaw Convention, any airline may modify schedules and/or routes, and even the departure and arrival airports, without prior notice. If the airline makes any modifications, such as technical issues, weather conditions, or political events outside the control of Nomadays, delays, cancellations, or strikes not related to the Local Agency, extra stops, aircraft changes, political or weather events, and the Client decides to cancel the trip, cancellation fees as outlined in section 4.2 above will be charged. The Local Agency will not reimburse additional costs (taxi, hotel, transport, meals, etc.) once the Client is under the protection of the airline.

In the event of delays, lost baggage, denied boarding (overbooking), and/or flight cancellations by the airline, the Client is advised to keep all original documents (tickets, boarding passes, baggage coupons, etc.) and request written proof from the airline in case of denied boarding (overbooking) or flight cancellation.

The Client should submit their claim to the airline as soon as possible, within the short deadlines imposed, along with the necessary documentation and keep the originals.

VI.3. Modification of transport services

Any changes to the name or surname after registration that require rebooking the flight will incur fees equal to the price of the new tickets.

Therefore, the total price billed by the Local Agency may differ from the initial quote due to adjustments in airline pricing (e.g., fuel surcharge adjustments, seat rescheduling, or class changes).

If the Client makes modifications to the trip that affect any domestic flights, the modification fees will be equal to the price of the new tickets.

VI.4. Reconfirmation

Any required reconfirmation of the return flight is the full responsibility of the client.

VII. Insurance

VII.1. Travel insurance contract

To participate in our trips, you must be covered by assistance-repatriation and medical expenses insurance abroad.

The Local Agency and Nomadays offer the Client a specific insurance package for the trips. This package has been developed with CHAPKA ASSURANCES and AXA ASSISTANCE, and we strongly encourage you to review the contract with our partner and we highly suggest subscribing to it.

If you choose to subscribe to one of these packages, the detailed agreement outlining all the guarantees and claim declaration procedures is available on the insurer's website. The Client is encouraged to read it carefully. It is their responsibility to personally contact the insurer before or during the trip to activate the insurance contract. The participant should therefore keep the contract with them throughout the trip.

VII.2.2. Other requests

VIII. Minors

Registration requests for minors must be signed by the father, mother, or legal guardian and include the mention "agreement of the father, mother, or guardian."

Minors traveling without their parents or guardians must carry, in addition to the required identity documents for the trip, a valid authorization to leave metropolitan France.

Furthermore, a phone number and an address must be provided to enable the minor or the responsible person to establish direct contact.

For minors traveling with one parent, a guardian, or another adult, it is the responsibility of the accompanying person to ensure they have the necessary documents to allow the minor to leave the country (national identity card or passport and, if applicable, the authorization to leave the territory).

IX. Price revision terms

The prices provided in quotes are based on the following economic factors:

  • cost of transportation and fuel,
  • fees and taxes related to included services, such as landing, boarding, and disembarking taxes in ports and airports,
  • exchange rates of the currencies affecting the cost structure.

These economic factors are taken into account at the time of issuing the brochure and/or quote. In accordance with Articles L 211-12, R.211-8, and R.211-9 of the French Tourism Code, the prices in the contract may be revised upwards or downwards to reflect variations in the cost of transportation (fuel/energy), fees, taxes, and exchange rates. The Client will be notified of any increase in the total price of the package no later than 20 days before departure. This increase will apply entirely to the concerned portion of the price.

In case of a price increase exceeding 8%, the Client will receive a detailed breakdown of the price change, its consequences on the package price, the option to accept or decline within a reasonable timeframe, and the consequences of failing to respond.

X. Liability

The Local Agency will not be held responsible for the following events:

  • The Local Agency will not be held responsible for the following events:
  • Loss or theft of flight tickets (as airlines do not issue duplicates).
  • Failure to present or presentation of expired or insufficiently valid identity and/or health documents (identity card, passport, visa, vaccination certificate, etc.), or documents not conforming to the required formalities at customs, police checks, or check-in.
  • Failure to check-in (including delays in boarding).
  • Unpredictable and insurmountable events caused by a third party unrelated to the Local Agency, such as: wars, political unrest, administrative authority orders, strikes outside the control of the Local Agency, technical incidents not caused by the Local Agency, airspace congestion, weather conditions, delays (including delays in mail services for delivering travel documents), mechanical failures, loss or theft of luggage or other belongings.
  • Delays, cancellations, and potential modifications to the itinerary resulting from the above cases will not entitle the Client to any compensation, particularly in the event of changes to the duration of the trip or delays in connecting flights. Any additional costs related to disruptions (taxes, hotels, parking, etc.) will remain the Client’s responsibility.
  • Quality of infrastructure, telecommunication equipment, and medical evacuations available to the Client throughout the trip.
  • Level of medical treatment and services available locally, potential lack of doctors or qualified medical personnel, and unavailability of certain medications.

The Local Agency reserves the right to modify the dates, times, or itineraries if the Client’s safety cannot be guaranteed.

XI. Data protection

Requests for information and registrations are processed electronically.

Certain information must be provided to the Local Agency when registering and/or requesting a quote. This is clearly indicated with an asterisk. If these are not provided, the request cannot be processed. Other information is optional. Nomadays and the Local Agency inform the Client that in order to execute the travel services, their data will be shared with the Local Agency's partners (e.g., hotels, transporters).

Additionally, the Client's data may be used for commercial prospecting, such as sending promotional or commercial offers from the Local Agency and the Nomadays collective, in accordance with the law.

When browsing the Local Agency’s website, temporary cookies are placed on the user's computer to allow them to view and make purchases on the site. To disable them, the user must refer to their browser's settings. Disabling cookies may prevent the website from being used.

In accordance with the French "Informatique, Fichiers et Libertés" law No. 78-17 of January 6, 1978, every user of the website has the right to access, oppose, modify, rectify, and delete personal data concerning them. These rights can be exercised by sending a postal request to:

XII. Complaints

As a direct result of our affiliation with the Nomadays collective of local agencies, any complaint regarding your trip must be addressed to the Nomadays Customer Service by any means that allows for an acknowledgment of receipt, as soon as possible after your return, and accompanied by all supporting documents.
